On Wednesday, April 1, 2026, at 2:00 p.m. all assets of Element 7 Chula Vista One, LLC, Element 7 Mendota, LLC, Element 7 Willits, LLC, Element 7 SF1, LLC, Element 7 Redwood City, LLC, PH Investments Group, LLC, and Element 7 Cathedral City, LLC (including inventory, licenses, furniture, fixtures, equipment, IP, and other intangibles) will be sold via an out-of-Court auction led by Court-appointed Receiver Kevin Singer. This sale is free and clear of liens.

The opening bid will be $1,000,000, with bidding increments of $100,000 thereafter until a winner is determined.

To prequalify to bid, bidders must present the Receiver the following by 5:00 p.m. on March 31, 2026: (a) a signed copy of these Rules for Out-of-Court Auction; (b) a deposit of $100,000, either via wire transfer/ACH or a cashier’s check in the amount of $100,000 made out to Receivership Specialists; (c) proof of funds in an amount equal to or greater than the highest amount the bidder is willing to bid; and (d) evidence demonstrating that the bidder would be a qualified operator of the Business pending transfer of the relevant license.

Element 7 Chula Vista One, LLC does not have a local permit to operate in the city of Chula Vista. Element 7 Chula Vista One, LLC’s state license will expire on or about May 18, 2026.  

On or about May 8, 2025, Element 7 Chula Vista One LLC (“Element 7”) submitted an application to renew City License prior to its expiration on June 13, 2025.  On June 12, 2025, the City notified Element 7 that the renewal of the City License was “Conditionally Approved” and it could continue operations. On June 18, 2025, the City issued a Denial of Application for Renewal with the following statement: “This denial is effective June 19, 2025, and all related Commercial Cannabis Activities must cease immediately. You have the right to seek judicial review of the City Manager’s decision.” On or about September 17, 2025, Element 7 filed a Petition for Writ of Mandate in San Diego County Superior Court Case No. 25CU049457C. On or about January 8, 2026, the city of Chula Vista filed an Answer in response to the Writ of Mandate. No hearing has been scheduled for the Writ of Mandate.
