What is it?


The underlying vehicle for BizTrader.com’s initiative is called an “Investment Visa.” The employment-creation immigrant visa program was established as part of the US Immigration Act of 1990. Also known as the EB5 program, it authorizes 10,000 immigrant visas to investors who invest $1,000,000 (or $500,000 in select areas) in a US business that will result in the creation of at least 10 U.S. jobs. This investment can include the creation of a new business, the purchase of an existing business that will be restructured or reorganized in a way that results in a new business, or the expansion of an existing business that results in a 40% increase in net worth or the number of employees. This program is applicable to businesses established after November 29, 1990. Investors who meet these qualifications will be granted what is essentially “green card” status: they become a conditional permanent resident alien. Status is also granted to immediate family members, including children under the age of 21.


How does it work?


First, immigrant investors must file a petition, along with complete documentation. This includes proof that the commercial enterprise has been established, the requisite capital has been invested, and jobs have been created. Immigrant must also provide documentation that the investment money was legally obtained, along with articles of incorporation, partnership agreements, financial reports, payroll records, and other relevant information. The United States Citizenship and Immigration Services (USCIS) will review these materials along with the IRS to determine authenticity. Once an investor’s petition is approved, an investor immigrant visa will be granted to the petitioner as well as to immediate family members.


Are there other programs?


Immigrant investors may also qualify for an E-2 Treaty Investor if they hail from a country that maintains a treaty of commerce with the United States. This is a long-term temporary visa that usually lasts for two years, and extensions are generally easy to obtain. To be eligible, the applicant must enter the US with the purpose of carrying out substantial trade, of developing or managing the operations of a company in which they have invested, or of investing a substantial amount of capital. The applicant must have more than 50% ownership in the investment they’re coming to manage. As with EB5 visas, spouses are granted entry into the US and are eligible to accept employment.
